line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第一条&nbsp;</span><span style="font-family: 仿宋;font-size: 21px">&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">为贯彻落实《国务院办公厅关于做好跨周期调节进一步稳外贸的意见》(国办发〔</span><span style="font-family:仿宋_GB2312">2021〕57号)、《福州市人民政府关于印发福州市积极应对疫情影响进一步帮助市场主体纾困解难若干措施的通知》(榕政综〔2022〕110号)等有关文件,增强金融服务跨境贸易能力,充分发挥财政资金的引导作用,缓解跨境电商等跨境贸易企业融资难问题,结合我市实际,设立福州市跨境贸易专项补偿资金池,为确保资金池高效、规范、安全运行,特制定本管理办法。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第二条&nbsp;</span><span style="font-family: 方正仿宋_GB2312;font-size: 21px">&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">福州市跨境贸易专项补偿资金池(</span><span style="font-family: 仿宋_GB2312;font-size: 21px">以</span><span style="font-family: 仿宋_GB2312;font-size: 21px">下</span><span style="font-family: 仿宋_GB2312;font-size: 21px">简</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">称</span><span style="font-family:仿宋_GB2312">“资金池”)是为福州市跨境贸易企业融资风险补偿而设的专项资金。</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">资金池</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">首期启动规模</span><span style="font-family:仿宋_GB2312">8000万元,由市商务局外贸出口信用保障专项资金中的2000万元,自贸区福州片区管委会的1000万元,以及市城投集团、市古厝集团、市国资集团、市金控集团、市左海集团各出资1000万元组成</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">后续视资金池运作情况和实际效果调整额度。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第三条&nbsp;</span><span style="font-family: 方正仿宋_GB2312;font-size: 21px">&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">合作金融机构按照资金池</span><span style="font-family:仿宋_GB2312">10倍以上的比例投放相应信贷或保险额度给福州市跨境贸易企业,跨境贸易企业出现风险后,各方按约定及本办法规定承担风险责任。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第四条&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;<span style="font-family:仿宋_GB2312">资金池先期采取</span><span style="font-family:仿宋_GB2312">“跨境贷”模式运行。</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">“跨境贷</span><span style="font-family: 仿宋_GB2312;font-size: 21px">”指的是</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">遵循</span><span style="font-family:仿宋_GB2312">“政府引</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">导、市场运作、风险共担</span><span style="font-family:仿宋_GB2312">”原则,</span></span><span style=";font-family:仿宋_GB2312;font-size:21px"><span style="font-family:仿宋_GB2312">构建政府性融资担保机构(以下简称</span><span style="font-family:仿宋_GB2312">“担保机构”)增信机制</span></span><span style=";font-family:仿宋_GB2312;font-size:21px">,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">由合作投放机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">为跨境贸易企业</span><span style="font-family: 仿宋_GB2312;font-size: 21px">办理</span><span style="font-family: 仿宋_GB2312;font-size: 21px">贷款、贸易融资</span><span style="font-family: 仿宋_GB2312;font-size: 21px">业</span><span style="font-family: 仿宋_GB2312;font-size: 21px">务的金融服务方式。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第五条&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;<span style="font-family:仿宋_GB2312">资金池后续可根据业务开展情况,增加</span><span style="font-family:仿宋_GB2312">“跨境保”模式。</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">“跨境保”指的是在资金池的助力下,通过“政府+保险机构+跨境贸易企业”风险共担的模式,保险机构在降低赔付比例的基础上扩大对跨境贸易企业的保险限额的金融服务方式。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family:楷体_GB2312;font-weight:bold;font-size:21px">第六条&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;<span style="font-family:仿宋_GB2312">资金池支持的跨境贸易企业原则上应为福州市内登记注册、具有独立法人资格的企业,具备正常生产经营条件,在海关有出口数据,无安全、质量、环保、报关、报税、诚信等方面的重大问题,无不良信用记录。</span></span></p><p style="text-align: justify;"><span style="font-family: Calibri;font-size: 12px">&nbsp;</span></p><p style="text-align: justify;"><span style="font-family: Calibri;font-size: 12px">&nbsp;</span></p><p style="text-align: justify; line-height: 40px;"><span style="font-family: 黑体;font-size: 21px"><span style="font-family:黑体">第二章</span> &nbsp;<span style="font-family:黑体">部门职责与分工</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px">第七条</span></strong><span style="font-family: 方正仿宋_GB2312;font-size: 21px">&nbsp;&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">成立由市商务局、自贸区福州片区管委会、市地方金融监管局、市财政局等部门组成的跨部门工作小组,跨部门工作小组及各部门各自履行相应职责。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(一)跨部门工作小组主要负责:</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.根据需要修改、完善资金池管理办法;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">2.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">根据需要</span><span style="font-family: 仿宋_GB2312;font-size: 21px">确定合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">增信</span><span style="font-family: 仿宋_GB2312;font-size: 21px">机构;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">3.审议监督资金池运作管理情况;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">4.根据资金池受托管理机构(以下简称“资金池管理人”)的管理费用申请,会审作出拨付决定;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">5.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">根据合作增信机构的风险补偿申请,会审作出补偿决定,通知资金池管理人给予拨付;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">6.对资金池管理人履职尽责情况进行考核、调整;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">7.负责开展资金池资金绩效评价工作;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">8.研究</span><span style="font-family: 仿宋_GB2312;font-size: 21px">处置</span><span style="font-family: 仿宋_GB2312;font-size: 21px">资金池运行的其他重大事项等。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(二)市商务局主要负责:</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.负责跨部门工作小组的召集、协调工作;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">2.向市财政局申报资金预算;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">3</span><span style="font-family: 仿宋_GB2312;font-size: 21px">.受理合作增信机构的风险补偿申请和资金池管理人的管理费用申请,召集跨部门工作小组进行会审,并根据会审结果通知资金池管理人在资金池中予以划扣;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">4</span><span style="font-family: 仿宋_GB2312;font-size: 21px">.会同自贸区福州片区管委会、市地方金融监管局和合作金融机构开展政策宣导工作。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(三)自贸区福州片区管委会主要负责:</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.协调福州自贸片区内相关金融机构参与相关业务;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">2.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">会同市商务局、市地方金融监管局和合作金融机构开展政策宣导工作。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(四)市地方金融监管局主要负责:</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.协调相关金融机构参与相关业务,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">督促</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">合规经营;</span><span style="font-family: 仿宋_GB2312;font-size: 14px">&nbsp;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">2.会同市商务局、自贸区福州片区管委会和合作金融机构开展政策宣导工作;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">3.协调人民银行福州中心支行鼓励和引导金融机构加大“跨境贷”投放力度。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(五)市财政局主要负责:</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.审核资金池预算安排;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style=";font-family:仿宋_GB2312;font-size:21px">委托福州市融资担保有限责任公司对</span><span style=";font-family:仿宋_GB2312;font-size:21px">资金池</span><span style=";font-family:仿宋_GB2312;font-size:21px">进行</span><span style=";font-family:仿宋_GB2312;font-size:21px">日常管理</span><span style=";font-family:仿宋_GB2312;font-size:21px">。</span><span style=";font-family:仿宋_GB2312;font-size:21px">资金池管理人要</span><span style=";font-family:仿宋_GB2312;font-size:21px">根据有利于风险控制和服务便捷的原则,按照有关规定</span><span style=";font-family:仿宋_GB2312;font-size:21px">和业务需要</span><span style=";font-family:仿宋_GB2312;font-size:21px">选择银行</span><span style=";font-family:仿宋_GB2312;font-size:21px">业金融机构设立资金专户</span><span style=";font-family:仿宋_GB2312;font-size:21px">,封闭运作、专款专用,实行动态管理</span><span style=";font-family:仿宋_GB2312;font-size:21px">,利息收益结转进入资金池</span><span style=";font-family:仿宋_GB2312;font-size:21px">。资金池管理人主要职责:</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">1.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">向跨部门工作小组报备资金池管理方案,并负责资金池日常管理和财务核算;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">2.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">根据使用情况向市商务局提交资金使用预算报告和资金池增补方案;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">3.</span><span style="font-family: 仿宋_GB2312;font-size: 21px">向跨部门工作小组提出风险补偿申请、管理费用申请,根据跨部门工作小组会审结果拨付资金;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px">第九条</span></strong><span style="font-family: 楷体_GB2312;font-size: 21px">&nbsp;&nbsp;</span><strong><span style="font-family: 楷体_GB2312;font-size: 21px">资金池管理</span></strong><strong><span style="font-family: 楷体_GB2312;font-size: 21px">费</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">资金池管理费原则上按一个周期年末资金池余额的</span><span style="font-family: 仿宋_GB2312;font-size: 21px">0.5</span><span style="font-family: 仿宋_GB2312;font-size: 21px">%予以</span><span style="font-family: 仿宋_GB2312;font-size: 21px">结算</span><span style="font-family: 仿宋_GB2312;font-size: 21px">,</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">最高不超过</span><span style="font-family:仿宋_GB2312">50万元,</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">且</span><span style="font-family: 仿宋_GB2312;font-size: 21px">结算</span><span style="font-family: 仿宋_GB2312;font-size: 21px">金额不超过一个周期年末资金池利息收益总额。资金池管理费提取经跨部门工作小组会审同意后,由资金池管理人在资金池利息收益中扣划。</span></p><p style="line-height: 40px; line-height: 37px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px">第十条</span></strong><span style="font-family: 楷体_GB2312;font-size: 21px">&nbsp;&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">“跨境贷”主要用于满足跨境贸易企业生产经营过程中合理的流动资金需要,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">企业贷款利率不宜超过银行同类产品利率水平。</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">贷款期限为一年,还款方式可采取分期或者到期一次性偿还本金、自助可循环等。小微企业单户贷款金额原则上不超过</span><span style="font-family:仿宋_GB2312">1000万元;中型以上企业可适当扩大贷款规模,</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">原则上不超过</span><span style="font-family: 仿宋_GB2312;font-size: 21px">2</span><span style="font-family: 仿宋_GB2312;font-size: 21px">000万元。成长性高的外贸龙头企业(出口或进口的上年业绩或当年累计业绩,排名全市前30名)可一事一议。</span></p><p style="text-indent: 43px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px">第十二条</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">鼓励</span><span style="font-family:仿宋_GB2312">“跨境贷”合作投放机构为到期贷款提供无还本续贷服务。对实力较强、成长性较好的续贷客户,应考虑适当降低贷款成本。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(一)申贷。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">跨境贸易企业向</span><span style="font-family:仿宋_GB2312">“跨境贷”业务合作</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">机构提出</span><span style="font-family:仿宋_GB2312">“跨境贷”申请,也可通过“金服云”等平台提出申请。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(二)审贷。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">机构根据各自业务操作管理规定以及合作约定进行审贷工作,并向该企业提供相关业务咨询和相关信息。审贷结果应及时通知</span><span style="font-family:仿宋_GB2312">“跨境贷”业务申请人。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(三)放贷。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">“跨境贷”业务申请人接到通知后,应先向合作金融机构提供所需材料并与其签订借款、担保合同,支付担保费,合作投放机构在落实放贷手续后给予放贷。从受理贷款申请到贷款审批完成一般不超过15个工作日。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(四)续贷。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">贷款期满前一个月,跨境贸易企业可向合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px">机构提出续贷申请,合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px">机构应按有关续贷政策简化办理手续。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px"><span style="font-family:楷体_GB2312">第十五条</span> &nbsp;<span style="font-family:楷体_GB2312">风险监管</span></span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(一)各方职责。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">合作投放机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">应指定专门部门承担</span><span style="font-family:仿宋_GB2312">“跨境贷”实施工作,按照银保监部门监管要求做好业务实施全过程的风险管控。</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">在贷款期限内,贷款企业应建立健全信息披露制度,定期向为其提供融资服务的合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px">机构提供财务情况、业务经营情况、重大事项等信息。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(二)贷后、保后管理。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">“跨境贷”发放后,合作投放机构和</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">应按各自贷后、保后管理制度落实跟踪管理,密切关注企业生产经营情况及可能影响贷款安全重大事件,如任何一方发现贷款企业异常情况,应及时告知其他方。对于异常情况经协商一致后提出风险处置预案,如发现贷款企业未按约定用途使用资金的,各方有权采取宣布贷款提前到期、提前收回贷款等风险控制措施;如对贷款企业因经营困难发生不能按期还本付息的,各方有权采取相应的保全措施或予以清收。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(三)风险警戒。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">对单个合作投放机构</span><span style="font-family:仿宋_GB2312">“跨境贷”不良贷款率超过5%时,由</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">及时告知跨部门工作小组,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">并</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">暂停与该机构</span><span style="font-family:仿宋_GB2312">“跨境贷”业务的合作,待合作投放机构进行整改、报请跨部门工作小组会商同意后,方可恢复合作。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(四)退出机制。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">若受授信政策、财政预算等因素影响,本资金池难以继续执行,跨</span><span style="font-family: 仿宋_GB2312;font-size: 21px">部门工作小组、合作金融机构可共同决议终止资金池运作。决议生效后,已签合同但尚未履行完毕的存量授信继续履行。对正常生产经营、仍有资金需求的企业,合作</span><span style="font-family: 仿宋_GB2312;font-size: 21px">投放</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">机构应以不影响企业生产经营为前提,在</span><span style="font-family:仿宋_GB2312">3年内实现存量客户的稳步退出或替换原授信方案。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px"><span style="font-family:楷体_GB2312">第十六条</span> &nbsp;<span style="font-family:楷体_GB2312">风险补偿流程</span></span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">企业</span><span style="font-family:仿宋_GB2312">“跨境贷”贷款发生逾期时,合作金融机构应及时向跨部门工作小组报告有关情况,按有关规定组织催收,并启动代(补)偿程序,各方按约定承担相应风险责任。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-weight: bold;font-size: 21px">(一)</span><strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">符合省再担保机构、国家融资担保基金分险条件的</span><span style="font-family:仿宋_GB2312">“跨境贷”业务</span></span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">主要针对小微企业</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">)</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">2.补偿申请。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">在追偿程序进入司法强制执行程序后一年或司法部门出具相关法律文书终结(中止)执行的,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">代偿总额扣除政府性融资担保体系</span><span style="font-family: 仿宋_GB2312;font-size: 21px">应承担的本金风险责任和</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">分配到政府性融资担保体系(省再担、国融担及自身)的追偿所得,差额部分即认定为代偿净损失,在每年</span><span style="font-family:仿宋_GB2312">4月前向跨部门工作小组就代偿净损失提出补偿申请。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">3.会审。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">跨部门工作小组会审通过后按相关程序拨付资金,并核销贷款损失。对超风险资金的,由市商务局会同市财政局另行安排资金给予补偿。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-weight: bold;font-size: 21px">(二)</span><strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">不符合省再担保机构、国家融资担保基金分险条件的</span><span style="font-family:仿宋_GB2312">“跨境贷”业务</span></span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">(</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">主要针对非小微企业</span></strong><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">)</span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">2.预拨付申请。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">在代偿后的次月</span><span style="font-family:仿宋_GB2312">10日前向跨部门工作小组提交代偿预拨付申请,申请金额为本金损失部分的40%。</span></span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">3.会审。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">跨部门工作小组会审通过后在资金池上限范围内按相关程序预拨付资金。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 仿宋_GB2312;font-size: 21px">4.核销申请。</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px">在追偿程序进入司法强制执行程序后一年或司法部门出具相关法律文书终结(中止)执行的,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">扣除分配到其的追偿所得</span><span style="font-family: 仿宋_GB2312;font-size: 21px">,差额部分即认定为代偿净损失,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">向跨部门工作小组提出</span><span style="font-family: 仿宋_GB2312;font-size: 21px">代偿</span><span style="font-family: 仿宋_GB2312;font-size: 21px">净损失核销申请,跨部门工作小组通过会审进行确认。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px"><span style="font-family:楷体_GB2312">第十七条</span> &nbsp;</span></strong><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">合作投放机构开展</span><span style="font-family:仿宋_GB2312">“跨境贷”业务不得出现下列情形</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">:</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(一)贷款授信审批时,企业未依法注册登记、未正常公示或开业不满一年的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(二)贷款授信审批时,企业、法定代表人、控股股东、实际控制人在其他贷款机构有不良贷款的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(三)贷款授信审批时,未对企业进行征信调查的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(四)落实担保条件时,未将企业法</span><span style="font-family: 仿宋_GB2312;font-size: 21px">定</span><span style="font-family: 仿宋_GB2312;font-size: 21px">代表</span><span style="font-family: 仿宋_GB2312;font-size: 21px">人</span><span style="font-family: 仿宋_GB2312;font-size: 21px">、控股股东或实际控制人及其配偶(若有)作为贷款连带保证责任人的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(五)未落实贷款合同约定的放款条件发放贷款的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(六)贷款发放后,未按要求向资金池管理人备案的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(七)企业贷款用于非主业经营活动的,如房地产投资、有价证券购买等;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(八)贷款逾期后,未按相关规定进行催收的;</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">(九)未经跨部门工作小组和资金池管理人同意,擅自放弃对不良贷款的追偿的。</span></p><p style="line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">&nbsp;&nbsp;&nbsp;</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">先行代偿前应对合作投放机构发放贷款情况进行审核,审核过程中如发现合作投放机构发放贷款存在以上情形之一,不予代偿。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><strong><span style="font-family: 楷体_GB2312;font-size: 21px"><span style="font-family:楷体_GB2312">第十八条</span> </span></strong><strong><span style="font-family: 楷体_GB2312;font-size: 21px">&nbsp;<span style="font-family:楷体_GB2312">追偿清收</span></span></strong></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:仿宋_GB2312">合作金融机构应按照相关法律法规对贷款企业、担保企业和反担保方积极开展追偿清收工作,对已核销的贷款业务要做好</span><span style="font-family:仿宋_GB2312">“账销案存”工作</span></span><span style="font-family: 仿宋_GB2312;font-size: 21px">,</span><span style="font-family: 仿宋_GB2312;font-size: 21px">若后续有追偿所得,由担保机构核算资金池应得款项,在报请跨部门工作小组确认后将资金池应得款项返还资金池</span><span style="font-family: 仿宋_GB2312;font-size: 21px">。合作金融机构就上述情况每半年度向跨部门工作小组作书面报告,追偿所得由资金池和合作投放机构、</span><span style="font-family: 仿宋_GB2312;font-size: 21px">担保机构</span><span style="font-family: 仿宋_GB2312;font-size: 21px">等各方按实际风险分担比例进行分配。合理追索费用一般在申请代偿净损失补偿或贷款净损失核销时一并经跨部门工作小组确认,确认后多退少补。</span></p><p style="text-indent: 43px; line-height: 40px; text-align: justify;"><span style="font-family: 仿宋;font-size: 21px">&nbsp;</span></p><p style="text-align: justify; line-height: 40px;"><span style="font-family: 黑体;font-size: 21px"><span style="font-family:黑体">第五章</span> &nbsp;<span style="font-family:黑体">“跨境保”运作方式</span></span></p><p style="text-indent: 43px;
