2em;">陈老太家与何依伯家的房屋南北相邻，何依伯家房屋在2015年翻建时，两家签订了《建房协议书》。协议书约定，何依伯家房屋南向挑出的阳台至少要与陈老太家房屋外墙保持1.5米的空间，陈老太家房屋西向要保持3米宽通路以保障何依伯一家通行。2023年初，陈老太也准备翻建房屋，但何依伯却不同意在房屋四至协议上签名确认，无奈之下陈老太便以何依伯家房屋挑出的阳台超过了约定的空间为由提起了相邻关系诉讼。</span><br/></p></section></section></section></section><section normal;">因陈老太家的房屋属于历史旧房，庭审结束后，承办法官积极与镇政府、村委会沟通，将陈老太家房屋的历史四至问题落实清楚。随后，承办法官第一次进行登门调解。但双方的矛盾由来已久，宗族之间关系复杂，何依伯一家对调解工作颇有抵触，第一次的调解以失败告终。</p><p style="text-indent: 2em;white-space: 222);">见此，承办法官积极与村委联动，邀请当地乡贤，依托村委办公点开展第三次调解。</span>承办法官耐心地从邻里关系方面做思想工作，又列举了清朝大学士张英“六尺巷”的典故，乡贤也从“邻居处得好胜似捡个宝”的朴素真理出发引导双方正确认识和处理相邻关系，使得双方心情逐渐平复，关系得到缓和，最终双方均解开心结，就相邻关系纠纷及案外的建房问题一揽子达成和解，陈老太一家主动向法院申请撤诉。</span><br/></p></section></section></section></section><section normal;">相邻关系是指毗邻的两个以上不动产所有人、用益物权人或者占有人，在用水、排水、通风、采光等方面根据法律规定产生的权利义务关系。从古至今相邻关系纠纷案件时有发生，该类案件事情不大，但有些当事人对立情绪严重，易造成邻里关系紧张，甚至激发一些刑事案件，如果简单地一判了之，容易增加群众的怨气。本案中，法官积极引用“睦邻”传统文化，耐心安抚当事人情绪，邀请多方参与调解工作，最终实现案结、事了、人和，取得良好的社会效果。</p></section><section
